Woo, doesn't sound so serious.
If the touch screen doesn't respond it may need re-aligning, or calibration. Turn off the Nintendo 3DS system, then press and hold the buttons 'L, R, and X' then while holding the 3 buttons, press the power button (you may need 2 people to do this). Then, instead of turning on like normal, the calibration screen will come up. Follow the instructions on screen and it may work again.
How old is the person you bought the system for?
